ADVERTISEMENT FOR BIDS

Sealed bids must be mailed and received by Wednesday, February 24, 2021. Bids shall be mailed to the attention of Nina Rivas, Clerk Treasurer, 6070 Central Avenue, Portage, Indiana. Bids will be publicly opened and read aloud at the meeting of the City of Portage Redevelopment Commission on February 25, 2021 at 4:00 p.m. for the following:

ROBBINS ROAD EXTENSION AT WILLOWCREEK ROAD

Digital copies of the Contract Documents may be obtained from the Office of the Department of Planning and Community Development, by emailing Sonya Lindgren at slindgren@portage-in.com. No paper copies will be available.

A pre-bid conference for this project has not been scheduled.

Each bid must be accompanied by a Bid Bond or Certified Check, for not less than ten percent (10%) of the total amount of the bid payable to the City of Portage as security for execution of the contract under the terms embodied in the Contract Documents.

Bid security of all excepting the three lowest responsive, responsible Bidders will be returned within fifteen (15) days after the opening of bids. The remaining bid securities will be returned within fourteen (14) days after the successful Bidder has executed the contract, bonds, etc. If the contract is not executed, any Bidder whose bid security has been retained may, after sixty (60) days after the opening of bids, request return of his bid security provided he has not been notified of acceptance of his bid.

Any bid may be withdrawn prior to the scheduled time for the opening of bids or authorized postponement thereof. However, no bid may be withdrawn for sixty (60) days after the scheduled time for opening, unless agreed to by the City of Portage or specifically permitted by law.

Each successful bidder and any and all levels of subcontractors, regardless of tier, as a condition of being awarded a contract or subcontract will agree to abide by the provisions of the Responsible Bidding Practices and Submission Requirements for Submitting Bids to Perform Construction Work on Public Works Projects ordinance as approved by the City of Portage Common Council.

All Bidders are specifically directed to review the time schedule set forth in the “Instruction to Bidders” section of these Contract Documents for the time for full completion of the project. Liquidated damages shall be assessed for delayed completion as set forth in the “Instruction to Bidders” section of these Contract Documents.

Contracts will be entered into between the City of Portage as “Owner” and the successful Bidders. The award of the contract will be made by the City of Portage to the lowest, responsive, responsible Bidder. In determining the lowest responsive, responsible Bidder, the City of Portage will consider the Bid, and all other relevant facts or matters mentioned in the Contract Documents or which the City of Portage may legally consider in determining the lowest, responsive, responsible Bidder.

The City of Portage, in accordance with Title IV of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-Assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of religion, race, color, national origin, sex sexual orientation, gender identity, age, disability/handicap, and/or low income in consideration for an award.

The City of Portage reserves the right to reject any bid for failure to comply with all requirements of this “Advertisement for Bids” or any of the Contract Documents; however, it may waive any informalities or minor defects at its discretion.

The City of Portage further reserves the right to reject all bids.
