NOTICE OF VESSEL SALE BY U.S. MARSHAL
SALE: On the Order of Interlocutory Sale, dated January 5, 2023, issued by the United States District Court for the Eastern District of New York, and in accordance with Local Admiralty Rule C.2, NOTICE is hereby given that the Office of the United States Marshal for the Eastern District of New York, Vincent F. DeMarco, will sell by PUBLIC AUCTION to the highest bidder on Friday, February 17, 2023, at 12:00 p.m. local time, on the front steps of the United States Courthouse for the Eastern District of New York, 100 Federal Plaza, Central Islip, New York 11722, the motor vessel known as THE FREEPORT PRINCESS, official number 696744, its masts, boilers, cables, engines, machinery, bowspirits, sails, riggings, bolts, anchors, chains, apparel, furniture, fittings, tools, pumps, equipment, fixtures, supplies, and all other appurtenances, accessors, additions, improvements, and replacements now or hereinafter belonging thereto, presently under arrest and seizure by the United States Marshal and found moored at 85 Woodcleft Avenue, Freeport, New York 11520.
TERMS: The highest and best bidder at the sale shall be required to deliver to the Marshal at the time of said sale, by certified check or cashier’s check payable to the Clerk of Court, a deposit in the sum of 10% of the successful bid. The balance must be delivered to the Marshal within three (3) business days thereafter, by certified check, cashier’s check, or wire transfer. All checks should be made payable to the Clerk of Court for the United States District Court of the Eastern District of New York. If any bidder should fail to pay into the Court the full balance of the purchase price due within three business days of the sale, then the deposit shall be forfeited to be treated as additional proceeds at the sale, and the Court may accept the second bid or order a new sale. The vessel shall be shall be conveyed by the United States Marshal to the successful purchaser “as is, where is,” free and clear of all liens and encumbrances. The sale will be subject to the confirmation of the Court.
INSPECTION: The Freeport Princess shall be available for visitation, boarding, inspection, examination and survey by potential bidders upon request, from the hours of 9:00 a.m. to 5:00 p.m. between the dates of February 11, 2023 and February 16, 2023, and from 9:00 a.m. to 12:00 noon, local time on February 17, 2023. Inspection can be arranged by appointment with Tranzon Auction Properties, the substitute custodian with present possession of the vessel. OBJECTIONS: Any and all objections to the sale must be made in writing and must be filed with the Clerk of the Court and the Marshal by the close of business on the third day following the sale, excluding Saturdays, Sundays, and legal holidays. Objections shall be accompanied by a cost deposit of seven days of estimated expenses of custody.
