Project Name: Human Options Shelter Rehabilitation Project
Project Description: Community Development Block Grant (CDBG) funds through the Department of Housing and Urban Development (HUD) will be used to install new vinyl plank flooring, closet doors, 5 new flat roofs, and the repair of 7 existing tile roofs on the property at the Human Options location located in Irvine CA. The Contractor shall supply all permits, labor, transportation, materials, apparatus, and tools necessary for the repairs. All required permits will be the responsibility of the contractor. The clean-up of all construction debris (daily and completion) of the project shall be the responsibility of the contractor.

NOTICE IS HEREBY GIVEN that Human Options, invites sealed bids for the above stated project and will receive, up to but no later than, the above-stated bid deadline, sealed bids at the place identified above for the award of a contract for the above project.

Such bids will be received in the Human Options Administration Office, 5540 Trabuco Road #100, Irvine, CA 92619, up to the hour of 10:00 A.M., on April 30, 2021. The bids will be publicly opened, via zoom and read at 10:30 A.M., on April 30, 2021.

A mandatory pre-bid meeting has been scheduled for 10:00 A.M. on Thursday, April 15, 2021 at the Human Options Administration Office, 5540 Trabuco Road #100, Irvine, CA 92619 to walk the project site and to receive information about the prevailing wage and contract compliance requirements. *Please note: all attendees will be subject to certifying they have not had any COVID like symptoms or have been in contact with anyone who exhibited COVID symptoms in the last two weeks before entering the premises.

Time of Work: 45 working days

Copies of the Bid Package that include the Work Description, Wage Rates, and Contractual Specifications are available from Human Options at the above mentioned address. The contract to be entered into pursuant to this Notice will be a federally assisted Community Development Block Grant funded construction contract.

This is a federally-funded construction contract. Federal Labor Standards Provisions, including prevailing wage requirements of the Davis-Bacon and Related Acts will be enforced. A copy of the Federal Wage Decision (found at http://www.wdol.gov) applicable to this project is included in the Bid Document. The rate of wages for each craft or type of work or mechanic employed under this contract shall be as specified under the current determinations of the Department of Labor required under the Davis-Bacon Act. In the event of a conflict between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates as determined by the State for similar classifications of labor (found at http://www.dir.ca.gov/OPRL/DPreWageDetermination.htm), the Contractor and its subcontractors shall pay not less than the higher wage rate. The Contractor’s duty to pay State prevailing wages can be found under Labor Code Section 1770 et seq. and Labor Code Sections 1775 and 1777.7 outline the penalties for failure to pay prevailing wages and employ apprentices including forfeitures and debarment. Attention is directed to Sections 1777.5, 1777.6 and 1777.7 of the California Labor Code and Title 8, California Administrative code, Section 200 et seq. to ensure compliance and complete understanding of the law regarding apprentices.

Minority and Women Owned Business: Bidders will be required to document their status as a Minority Business Enterprise (MBE), a Women-owned Business Enterprise (MBE) or a non-MBE/WBE firm. Bidders that are not MBE/WBE firms will be required to make a good faith effort, and to document their efforts to include firms as part of the contract bid. Families Forward hereby affirmatively ensures that all business enterprises will be afforded full opportunity to submit bids in response to this Notice and will not be discriminated against on the grounds of race, creed, color, or national origin in any consideration leading to the award of contract.

Section 3 Statement: This is a HUD Section 3 construction contract. First preference will be given to a bidder who provides a reasonable bid and is a qualified Section 3 Business Concern. Second preference will be given to a bidder who provides a reasonable bid and commits to achieving the Section 3 employment, training and subcontracting opportunity goals by submitting a written commitment (Economic Opportunity Plan).

Conflict of Interest: In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict of interest provisions in (State LCA – 24 CFR 85.36 and Non-Profit Organizations – 24 CFR 84.4), OMB Circular A-110, and 24 CFR 570.611, respectively, shall apply. No employee, officer or agent of the sub-recipient shall participate in selection, or in the award or administration of a contract supported by Federal funds if a conflict of interest, real or apparent, would be involved.

Bids must be prepared on the approved Proposal. The contract will be awarded to a Contractor who holds a valid A or B license in accordance with the provisions of the Business and Professions Code. Failure to possess the specified license shall render the bid as non-responsive and shall act as a bar to an award of the contract to any bidder not possessing said license at the time of award. The contractor and all subcontractors shall have a valid City of Irvine business license prior to commencing work.

Human Options reserves the right after opening, to reject any or all bids, to waive any informality in a bid, to make awards in the interest of Human Options and to reject all other bids. No oral interpretations will be made to any bidder as the meaning of the contract documents. Requests for an interpretation shall be made in writing and delivered to Human Options at least 7 days before the time announced for opening the proposals. Interpretations by the agency will be in the form of an addendum to the contract documents and, when issued, will be sent as promptly as is practical to all parties to whom the contract documents have been issued. All copies of the bid documents will be available by email by sending a request for bid with Human Options Shelter Rehabilitation Project in the subject line to Amorles@HumanOptions.org. All questions relative to this project prior to opening bids shall be prepared in writing and transmitted via e-mail to Andrew Morales at Amorales@HumanOptions.org.
