NOTICE TO BIDDERS
Solicitation Type and Name: Invitation to Bid for FM1926 (23rd Street) Intersection
Improvements (CSJ 1804-01-068, 1804-01-069, and 1804-01-071).
Solicitation Number: 08-21-C20-638
Summary of Work: The City of McAllen is accepting bids from qualifi ed bidders for the
improvements of Roadway widening to add dedicated left turn lanes along 23rd street (FM
1926) at the intersections of Kendlewood, Hackberry and Ebony Avenues.
Bid Opening: Sealed electronic bids addressed to Mr. Roel Roy Rodriguez P.E., City
Manager will be received until Thursday, August 26, 2021 at 4:00 p.m., Central Standard
Time (CST) at which time they shall be publicly opened in a meeting held in McAllen City Hall,
2nd Floor, Conference Room 2A. All bid responses are only to be submitted electronically
through the City of McAllen’s bidding portal: https://mcallen.procureware.com, on or before
the aforementioned date and time. Original, hard copy, and/or late bids shall not be accepted.
Pre-Submittal Conference: City of McAllen, City Hall, Conference Room 2A, 1300 Houston
Ave., McAllen, Texas 78501 on Thursday, August 19, 2021 at 10:00 a.m. CST. All prospective
respondents are encouraged to be in attendance.
To view this solicitation, access Plans and Specifi cations, and submit a bid response, you
must fi rst register in the City’s bidding portal at https://mcallen.procureware.com. Solicitation
documents will not be mailed, e-mailed, or provided in person. Once registered, you will also
be added to the solicitation distribution list for changes and/or additions via Addenda form.
A Bidder’s Bond from a reliable surety company licensed to operate in the State of Texas or
certifi ed Cashier’s Check, (Bid Security) payable without recourse to the City of McAllen, for
the amount of not less than fi ve percent (5%) of the total bid shall be submitted via a sealed
envelope as a guaranty that if awarded the contract, the bidder will enter into a contract with
the City of McAllen. The Bidder’s bid security shall be submitted before the above-mentioned
electronic bid opening date and time. Failure to submit the bid security shall be grounds for
disqualifi cation.
Bid Security shall be delivered in a sealed envelope and clearly marked as follows:

WAGE RATES
This project is to be fi nanced with Federal Highway Administration (FHWA) Funds and the
Davis-Bacon Act will apply. Minimum labor rates as established by the Secretary of Labor
shall apply and a schedule of labor classifi cation and wage rates to be paid as published in
the Federal Register are included to the specifi cations and will be made a part of the contract.
DBE POLICY:
The proposed project is fi nanced in part by Federal funds. It is the policy of the Department
of Transportation (DOT) that minority business enterprises as defi ned in 49 CFR Part 23 shall
have the maximum opportunity to participate in the performance of contracts fi nanced in whole
or in part with Federal funds.
Notice of Requirement for Affi rmative Action to Ensure Equal Employment Opportunity
(Executive Order 11246, as amended).
PRE-QUALIFICATION REQUIREMENTS
All bidders interested in submitting a bid must be prequalifi ed through TXDOT as an approved
vendor.
GENERAL
Plans and Specifi cations may be obtained by visiting our bidding portal at. https://mcallen.

. We are asking that vendors/contractors register online. Plans &
specs may be viewed electronically. Once on the portal, after you have logged in you can
click on the button titled Documents for details. Only TxDOT prequalifi ed contractors shall be
eligible to submit bids
Potential bidders are asked to post their questions on our bidding portal under the tab labeled
Clarifi cations under the relative project number.
The City of McAllen reserves the right to refuse and reject any or all Bids and to waive any or all
formalities or technicalities, and to award to low responsive and responsible bidder. and to hold
the bids for a period of one hundred and twenty (120) days without taking action thereon. Be
advised that if your company is contemplating on responding to this project you must register
on our portal so that any changes and/or additions via Addendum form can be forwarded to
your company.
