NOTICE TO BIDDERS

1. Notice is hereby given that the governing board (“Board”) of the Orange Unified School

District (“District”) will receive sealed bids for the following project (“Project” or “Contract”):

S2223-005 Canyon High School Building C Modernization

This is a Measure S Bond Program Project with scope of work that includes but is not limited to the following: Modernization of an existing one-story Biology, Chemistry, Math Classroom Building. Renovate to ten (10) General Classrooms, two (2) Living Skills Rooms with a Kitchen, Quiet Room, Speech, and Testing. Upgrade the two (2) Boys and Girls Rooms and provide an all-gender Restroom. Site work includes refurbishing the buildings courtyard and underground electrical and plumbing connections. Demolition of seventeen (17) portables including foundations, ramps, stairs, railings, and fence. Patch and repair exposed ground surface to match existing paving.

To bid on this Project, the Bidder is required to possess one or more of the following State of California contractors’ license(s): B

Additionally, the Bidder and any subcontractor designated to perform asbestos or hazardous materials abatement work is required to possess a DOSH ASB – Asbestos Certification and HAZ-MAT Certification pursuant to applicable California law in order to perform the work set forth in the Specifications sections that require asbestos-containing construction materials and/or hazardous materials related work.

This requirement applies to all subcontractors or any tier whether such subcontractor was designated pursuant to Public Contract Code section 4104 or not.

Any and all applicable licensing, certification(s), and/or training requirements must be met and remain current and valid throughout the term of the contracted work.

Bidders will be required to submit the Certifications within 24 hours after the District’s bid opening, to the contact listed in the bid: Ms. Jewelia Noriega, .

2. To bid on this Project, the Bidder is required to be registered as a public works contrac-

tor with the Department of Industrial Relations pursuant to Labor Code section 1725.5. The Bidder’s registration must remain active at the time of bid and throughout the term of the Contract.

3. Contract Documents will be available on or after February 2, 2023, online through the

PlanetBids Portal, https://pbsystem.planetbids.com/portal/15578/bo/bo-detail/101104. Downloads are available at no charge. General Project Document information, with a link to access the Project on the PlanetBids Portal, will also be posted on the District’s website at: orangeusd.org/departments/business-services/purchasing/bids>

The District does not ensure the availability, accuracy or completeness of plans, specifications, and any other bid documents related to this bid if they are not obtained from PlanetBids. It shall be the sole responsibility of the bidder to confirm and ensure it has received all bid documents for the Project.

5. All bids must be received electronically at or before 2:00 p.m. on March 9, 2023,

via PlanetBids Portal, https://pbsystem.planetbids.com/portal/ 15578/bo/bo-detail/101104

, at or after the deadline the bid results will be viewable online. Any bid that is submitted after this time shall be nonresponsive and returned to the bidder. Any claim by a bidder of error in its bid must be made in compliance with section 5100 et seq. of the Public Contract Code.

6. Pursuant to Public Contract Code section 20111.6, only prequalified bidders will be elig-

ible to submit a bid for the Project. See Instructions to Bidders for further details on which bidders must be prequalified. Any bid submitted by a bidder who is not prequalified shall be deemed nonresponsive and returned unopened to the bidder.

Moreover, any bid including subcontractors (as defined in Public Contract Code section 4113) holding C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43 or C-46 licenses (“MEP” subcontractors) who have not been prequalified, shall be deemed non-responsive and will not be considered. It is the sole responsibility of the bidder to ensure that all MEP subcontractors holding any of the licenses listed above are properly prequalified before submitting a bid. This prequalification requirement applies even if the MEP subcontractor will perform, or is designated to perform, work that does not require one of the licenses listed above, but the MEP subcontractor holds one of the licenses listed above.

The deadline for submission of prequalification documents by all prime contractors, and MEP subcontractors for this Project must be submitted online to Quality Bidders no later than 4:00 p.m. on March 1, 2023.

Prime contractors, and MEP subcontractors will be notified by e-mail of their prequalification rating not less than five (5) business days prior to the bid opening date. The Master list of prequalified prime contractors, and MEP Subcontractors will also be posted with the bid documents on PlanetBids portal.

The estimated value of this project is in excess of $7.5 million; therefore, requires the prime/general contractor to be prequalified with audited or reviewed financials to be eligible to bid this project. Interested bidders shall refer to the District’s prequalification requirements on Quality Bidders for all requirements.

7. All bids shall be on the form provided by the District and shall be accompanied by a sat-

isfactory bid security in the form of either a bid bond executed by the bidder and Surety Company, cash, or a cashier’s check or a certified check, drawn to the order of the Orange Unified School District, in the amount of ten percent (10%) of the total bid price. Said bid security shall be given to guarantee that the Bidder will execute the contract as specified, within seven (7) calendar days after the date of the Notice of Award. Each bid must conform and be responsive to all pertinent Contract Documents, including, but not limited to, the Instructions to Bidders.

8. A MANDATORY pre-bid conference and site visit will be held on February 10, 2023, at

10:00 a.m. at Canyon High School, 220 S. Imperial Hwy, Anaheim, CA 92807. Bidders shall meet in front of the Administration Building. Failure to attend the entire conference or tardiness will render the bid ineligible.

9. The successful Bidder shall be required to furnish a 100% Performance Bond and a 100%

Payment Bond if it is awarded the Contract for the Work.

10. The successful Bidder may substitute securities for any monies withheld by the District

to ensure performance under the Contract, in accordance with the provisions of section 22300 of the Public Contract Code.

11. The successful bidder will be required to certify that it either meets the Disabled Veter-

an Business Enterprise (“DVBE”) goal of three percent (3%) participation or made a good faith effort to solicit DVBE participation in this Contract if it is awarded the Contract for the Work.

12. The Contractor and all Subcontractors under the Contractor shall pay all workers on all

Work performed pursuant to this Contract not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the Director of the Department of Industrial Relations, State of California, for the type of work performed and the locality in which the work is to be performed within the boundaries of the District, pursuant to section 1770 et seq. of the California Labor Code. Prevailing wage rates are also available on the Department of Industrial Relations (“DIR”) website at: http://www.dir.ca.gov>.

13. This Project is subject to labor compliance monitoring and enforcement by the Depart-

ment of Industrial Relations pursuant to Labor Code section 1771.4 and subject to the requirements of Title 8 of the California Code of Regulations. The Contractor and all Subcontractors under the Contractor shall furnish electronic certified payroll records directly to the Labor Commissioner weekly and within ten (10) days of any request by the District or the Labor Commissioner. The successful Bidder shall comply with all requirements of Division 2, Part 7, Chapter 1, Articles 1-5 of the Labor Code.

14. The District shall award the Contract, if it awards it at all, to the lowest responsive res-

ponsible bidder based on:

A. Total Base Bid amount only.

15. The Board reserves the right to reject any and all bids and/or waive any irregularity in

any bid received or in the bidding. If the District awards the Contract, the security of unsuccessful bidder(s) shall be returned within sixty (60) days from the time the award is made. Unless otherwise required by law, no bidder may withdraw its bid for ninety (90) days after the date of the bid opening.
