NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:
On or about (At least one day after the end of the comment period), the Nassau County Office of Community Development will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Federal funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383) and the National Affordable Housing Act of 1990, as amended, to undertake the following project: Prybil Beach Fishing Pier Improvements
This project involves the renovation of Prybil Beach Fishing Pier by replacing the pier piling, deck, and rails. Improvements to the fishing pier will ensure the safety of all residents to use this free public amenity and the continuation of public events held at the pier annually. Funding request includes professional consultant fees to perform pier inspection of existing piles (underwater and exposed) as well as decking and railing on the popular Pier. Additionally, funding will incorporate preparation of plans and specifications for competitive bidding and bid phase services. The City anticipates funding construction of the project.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to County Nassau County Office of Community Development to the attention of Kevin Crean, Director at 1 West Street, Suite 365, Mineola, NY 11501. All comments received by Monday, March 29, 2021 (7 days from date of publication) will be considered by the Nassau County Office of Community Development prior to authorizing submission of a request for release of funds.
RELEASE OF FUNDS
The Nassau County Office of Community Development certifies to HUD that the County Executive, Laura Curran, in her official capacity, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Nassau County Office of Community Development to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objection to its release of funds and the Nassau County Office of Community Development certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Nassau County Office of Community Development; (b) the Nassau County Office of community Development has omitted a step or failed to make a decision of finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD, 26 Federal Plaza, Room 3504, New York, New York, 10278-0068. Potential objectors should contact HUD to verify the actual last day of the objection period.
