Sealed bids will be received by the Office of Parks and Recreation, of the Town of Dyer at the Town Hall, 1 Town Square, Dyer, Indiana 46311, until 10:00 AM, (local time) on March 3, 2023 for Cherry Hill Park Playground Improvements, Dyer, Indiana. The Bids will publicly be opened and read at 10:01 AM CST on March 3, 2023 at Town Hall.

Each bid must be accompanied by a Bid Bond or Certified Check, for not less than ten percent (10%) of the total amount of the bid payable to the Town of Dyer Parks and Recreation as security for execution of the contract under the terms embodied in the Contract Documents.

In addition, the Bid must be accompanied by the following Documents at the time of the Bid Opening:

a. Fully completed and executed State of Indiana Form 96, (Revised 2013).

b. A fully completed and executed Non-Collusion Affidavit of Prime Bidder, a copy of which is included as part of Form 96.

c. Bid Bond.

d. Bidder’s current Affirmative Action Program

e. Proof that the Contractor and all subcontractors on this project have met the requirements of Ordinance 2016-18.

Each successful bidder and any and all levels of subcontractors, regardless of tier, as a condition of being awarded a contract or subcontract shall enter into a Project Labor Agreement consistent with Ordinance No 2010-09 and comply with the requirements of the Town of Dyer Responsible Bidding Practices Ordinance No 2016-18 both adopted by the Town Council of the Town of Dyer, Lake County, Indiana.

Bids must be submitted on the Bid form included in these documents. The form must be fully completed and executed. No bids will be considered which are not based on these Contract Documents.

Bidders must be experienced in the construction of the type of facilities to be constructed under the contract for which a bid is submitted.

The bidder awarded the contract will be required to furnish a separate Performance Bond and Payment Bond, each in the amount of one-hundred percent (100%) of the contract price before commencing work. The Performance Bond and the Payment Bond shall remain in effect throughout the entire construction period.

Bid security of all except the two lowest responsive and responsible bidders will be returned within fourteen days after the bid opening. The remaining bid securities will be returned after the successful bidder has executed the Contract, posted bond and provided required certificates of insurance. If the contract is not executed, any bidder whose bid security has been retained may, after ninety days following the opening of bids, request return of his bid security, provided he has not been notified of acceptance of his bid.

Any bid may be withdrawn prior to the scheduled time of the opening of bids or authorized postponement thereof. However, no bid may be withdrawn for ninety days after the scheduled time for opening, unless agreed to by the Dyer Parks and Recreation Board.

The Dyer Parks and Recreation Board or representatives appointed by the Board will make the award of the contract. In determining who the lowest responsive and responsible Bidder is, the Dyer Parks and Recreation Board will consider the bid and all other relevant facts or matters mentioned in the Contract Documents which the Dyer Parks and Recreation Board may legally consider in determining the lowest responsive and responsible bidder.

The Dyer Parks and Recreation Board reserves the right to reject any or all bids. Without limiting the generality of the foregoing, any bid which is incomplete, obscure, conditional, not on the prescribed form, has erasures or corrections in prices, includes additions or deductions not called for or is not accompanied by the required bid security and supporting documents and information may be rejected. However, the Dyer Parks and Recreation Board reserves the right to waive any informalities or minor defects on the basis of the Board’s best interests.

The Dyer Parks and Recreation Board may make any investigation deemed necessary to determine the ability of a bidder to perform the work. Bidders shall furnish any information and data requested by the Dyer Parks and Recreation Board to facilitate such investigations. The Dyer Parks and Recreation Board reserves the right to reject any bid if the evidence submitted by, or investigation of, a bidder fails to satisfy the Dyer Parks and Recreation Board as to the bidder’s qualification to carry out the contract obligations.

The Dyer Parks and Recreation Board and the Town of Dyer will take notice of any prior dealings between Bidder and Town of Dyer and will rely on said prior dealings in determining if a Bidder is the lowest responsive and responsible bidder.
