NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Dianne Tarini to First Eastern Mortgage Corporation dated June 12, 1998, recorded with the Rockingham Registry of Deeds in Book 3300, Page 1027, as affected by a Corrective Mortgage dated June 12, 1998 and recorded in Book 3309, Page 1027, as assigned to Norwest Mortgage, Inc. dated September 28, 2021, by assignment recorded in Book 3328, Page 1024, further assigned to EMC Mortgage Corporation, by assignment dated June 25, 2007 and recorded in Book 4841, Page 988, and further assigned to DRRF II SPE, LLC, by assignment dated January, 21, 2014 and recorded in Book 5508, Page 2538, and further assigned to MFRA Trust 2014-1, by assignment dated October 5, 2015, and recorded in Book 5660, Page 413, and further assigned to Wilmington Trust, National Association, not in its individual capacity, but solely as Trustee of MFRA Trust 2014-1, by assignment dated July 27, 2018, and recorded in Book 5940, Page 2110, and further assigned to Wilmington Trust, National Association, not in its individual capacity, but solely as trustee for MFRA Trust 2014-2, by assignment dated November 15, 2021, and recorded in Book 6393, Page 108, of which mortgage the undersigned is the present holder for breach of conditions of said mortgage and for the purpose of foreclosing the same will be sold at PUBLIC AUCTION at 10:00 AM on FEBRUARY 22, 2023, on the mortgaged premises. The entire mortgaged premises, all and singular, the premises as described in said mortgage: All that certain premises and proportionate interest in the Gunstock Corner Condominium, a condominium at 203 East Main Street, Hampstead, Rockingham County, New Hampshire, more particularly described as follows: Unit 4, as defined, described and identified in the Declaration of Gunstock Corner Condominium (the “Declaration”), dated March 26, 1987, and recorded in Rockingham County Registry of Deeds, in Book 1668, Page 2186 and shown on a certain Site Plan entitled “Site Plan of Gunstock Corner Condominium by Fairview Land Survey, Inc., dated September, 1986 and on certain floor Plans entitled “Floor Plans of Gunstock Corner Condominium”, by the Cambridge Development Group, Inc. October 1986. The Premises are subject to all easements, rights, and restrictions of record. Being the same premises conveyed by deed to be recorded herewith. Subject to and with the benefit of easements, reservation, restrictions, and taking of record, if any, insofar as the same are now in force and applicable. In the event of any typographical error set forth herein in the legal description of the premises, the description as set forth and contained in the mortgage shall control by reference. This property has the address of 203 East Main Street, Gunstock Corner Condominium , Hampstead, NH 03841 Together with all the improvements now or hereafter erected on the property and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this sale. NOTICE PURSUANT TO NEW HAMPSHIRE RSA 479:25, YOU ARE HEREBY NOTIFIED THAT YOU HAVE THE RIGHT TO PETITION THE SUPERIOR COURT FOR THE COUNTY IN WHICH THE MORTGAGED PREMISES ARE SITUATED, WITH SERVICE UPON THE MORTGAGEE, AND UPON SUCH BOND AS THE COURT MAY REQUIRE, TO ENJOIN THE SCHEDULED FORECLOSURE SALE. If the second highest bidder declines to purchase the within described property, the Mortgagee reserves the right to purchase the within described property at the amount bid by the second highest bidder. The foreclosure deed and the consideration paid by the successful bidder shall be held in escrow by DOONAN, GRAVES, & LONGORIA LLC, (hereinafter called the “Escrow Agent”) until the deed shall be released from escrow to the successful bidder at the same time as the consideration is released to the Mortgagee, thirty (30) days after the date of sale, whereupon all obligations of the Escrow Agent shall be deemed to have been properly fulfilled and the Escrow Agent shall be discharged.
