NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE By virtue, and in execution of the Power of Sale contained in a certain mortgage dated March 31, 2022 given by Ariel LLC to RD CRB SPV LLC, said mortgage recorded with the Essex County (North) Registry of Deeds in Book 17397 Page 103, and which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00 p.m. on the 15th day of February 2023 at 80 Howe Street, Methuen, Massachusetts, all and singular the premises described in said mortgage. To wit: Property Address: 80 Howe Street, Methuen, Essex County, Massachusetts A certain tract of land, with any buildings thereon, in Methuen in said Essex County situated on the Westerly side of Howe Street being the Northerly half of lot numbered 230 and the whole of lot numbered 231 as shown on plan of Kensington Heights made by C.A. Thayer C.E. dated July 1908 recorded in Essex Co., N.D. Reg. of Deeds, Plan Book 1, Plan 9, both parcels being contiguous and taken together being bounded and described as follows: NORTHERLY one hundred fifteen and 82/100 (115.82) feet by lot numbered 232 as shown on said plan; EASTERLY sixty-three and 51/100 (63.51) feet by Howe Street; SOUTHERLY one hundred seven (107) feet more or less by land now or formerly of Alfred Lacharity the same being the Southerly half of said lot numbered 230 as shown on said plan; and WESTERLY sixty-three (63) feet by lots numbered 228 and 234 as shown on said plan; Containing 7,050 square feet more or less. The southeasterly corner of the granted premises is at a point in said Howe Street distant northerly sixty-three and 51/100 (63.51) feet from northerly line of Kensington Avenue measured along the westerly line of said Howe Street; the southwesterly corner of the granted premises is distant northerly sixty-three (63) feet from northerly line of Kensington Avenue measured in a line perpendicular with northerly line of said Kensington Avenue. For title see Deed recorded with the Essex North Registry on March 2, 2021 in Book 16797, Page 303. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens and rights of any tenants and parties in possession, if there be any, or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. The successful bidder will pay all costs of recording the foreclosure deed and any other foreclosure documents including, without limitation, all state and county excise stamp fees, and shall also be responsible for any Title V inspection and repair requirements. Terms of sale: A deposit of Five Thousand dollars ($5,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check to Baker, Braverman & Barbadoro, P.C., 300 Crown Colony Drive, Suite 500, Quincy, MA 02169 within thirty (30) days from the date of sale.
