SOUTH ESSEX SEWERAGE DISTRICT CONTRACT NO. 18-1 PRIMARY CLARIFIER CONCRETE RESTORATION CWSRF No. 4608 NOTICE TO BIDDERS Sealed bids for construction of CONTRACT NO. 18-1: PRIMARY CLARIFIER CONCRETE RESTORATION, CWSRF No. 4608, will be received at the Administration Building, South Essex Sewerage District, 50 Fort Avenue, Salem, Massachusetts 01970 until 1:00 p.m., local time, on May 13, 2021, and at that time and place bids will be publicly opened and read aloud by means of a telephone conference call. Due to the restrictions because of the COVID-19 pandemic, no member of the public will be allowed to physically attend the opening. To join the opening by telephone, call Go_to_Meeting at 1:00 p.m. on May 13, 2021: Dial in at: (872) 240-3412 Access Code: 842-645-541 Bidding will be in accordance with Massachusetts General Laws, Chapter 30, Section 39M. It is each bidder’s sole responsibility to make sure that its bid is received at the Administration Building, South Essex Sewerage District, 50 Fort Avenue, Salem, Massachusetts in the form and by the time specified herein. The deadline will be strictly enforced. Submission by facsimile or e-mail is prohibited. Bidders are advised that U.S. Mail deliveries to the District’s office have been irregular. Hand delivery is recommended. The Work consists of restoration of seven primary clarifier tanks and primary influent and effluent channels at the District Wastewater Treatment Plant in Salem, Massachusetts. The Work includes: removal, rehabilitation and reinstallation of sludge collection equipment, concrete and metallic surface preparation; repair and resurfacing; protective lining work including lining system terminations; environmental controls and proper disposal of all debris; and appurtenant and related work as more particularly indicated, shown or described in the Contract Documents. The Contract Time is 802 consecutive calendar days. A bid deposit shall accompany all bids and shall be in the form of a bid bond, cash, or certified, treasurer’s, or cashier’s check in the amount of five percent of the value of the bid including all alternates, if any are listed on the Bid Form. The Contract Documents will be available by going to www.projectdog. com entering Code # 842304 in the project locator box, and following the prompts to a free downloadable set. Contract Documents will be available for examination only at the Administration Building, South Essex Sewerage District, 50 Fort Avenue, Salem, Massachusetts during normal business hours, on or after April 14, 2021. There will be a pre-bid conference at the Administration Building, South Essex Sewerage District, 50 Fort Avenue, Salem, Massachusetts at 10:00 a.m., local time, on Wednesday, April 28, 2021. Attendance at the pre-bid conference is highly recommended. No bidder may withdraw its bid for a period of ninety days after the actual date of the opening of bids. The successful bidder must furnish a 100 percent Performance Bond and a 100 percent Labor and Materials Bond with a surety company acceptable to the District. Complete instructions for filing bids are included in the Information for Bidders section of the Contract Documents. Minimum Wage Rates as determined by the Commissioner of the Department of Workforce Development under the provision of Massachusetts General Laws, Chapter 149, Sections 26 to 27D, as amended, apply to this project. It is the responsibility of the bidder, before bid opening, to request if necessary, any additional information on Minimum Wage Rates for those trades people who may be employed for the proposed work under this contract. Federal Minimum Wage Rates as determined by the United States Department of Labor under the Davis-Bacon Act also apply to this project. The work under this contract is funded in part by the Massachusetts Water Pollution Abatement Trust (the “Trust”). Neither the Commonwealth of Massachusetts nor the Trust is a party to this contract. Bidders shall comply with the Commonwealth of Massachusetts Modified Supplemental Equal Opportunity, Anti-discrimination and Affirmative Action Program. Disadvantaged Business Enterprise (DBE) goals are applicable to the total dollars paid to the construction contract. The goals for this project are a minimum of 4.20 percent D/MBE participation and 4.50 percent D/WBE participation by certified DBEs. The two low bidders shall submit completed DBE forms (EEO-DEP-190C, EEO-DEP-191C and the DBE Certification of United States Citizenship form) by the close of business on the third business day after bid opening. Failure to comply with the requirements of this paragraph may be deemed to render a proposal non-responsive. No waiver of any provision of this section will be granted unless approved by the Massachusetts Department of Environmental Protection (“MassDEP”). This project requires compliance with the Massachusetts Diesel Retrofit Program (MDRP) by use of after-engine emission controls that are EPA certified, or their equivalent, on all of the off-road (non-registered) diesel vehicles/equipment used at the job site.
