NOTICE TO BIDDERS
Sealed bids for Hempstead Lake and South Pond Dam and Gatehouse Improvements atHempstead Lake State Park, 1000 Lake Drive, West Hempstead, Nassau County, New York, 11552will be received by the New York State Office of Parks, Recreation and Historic Preservation (OPRHP),Long Island at 625 Belmont Avenue, West Babylon, NY 11704 until 10:00 a.m. local time, Tuesday,June 8, 2021, when they will be publicly opened and read. Each bid must be prepared and submitted inaccordance with the Instructions to Bidders. All bids must be accompanied by Bid Security in the formof a certified check, bank check, or bid bond in the amount of: $110,000.00 (One Hundred TenThousand and Zero Cents).
GENERAL CONSTRUCTION CONTRACT: D005786
Scope of work is as follows:The purpose of this project is to restore and improve the outlet conditions at Hempstead Lake (“HL”)Dam at the Hempstead Lake State Park. The project proposes to replace the 5 cast iron sluice gates thatact as the primary outlets from HL, rehabilitate the HL gatehouse and the inlet gatehouse at South Pond,it includes repairs to the brick pipe arch connecting these two gatehouses as well as the dam stone liningimmediately east of the HL gatehouse, also includes partial demolition of the original outlet gatehousefor South Pond and provides electric to the improved HL Gatehouse, and includes site restoration. SinceHempstead Lake dam and South Pond were constructed around 1873, the proposed restoration work willmaintain the historical integrity of the structures, and has been approved by NYSOPRHP.
This project is being financed with U.S. Department of Housing and Urban Development (“HUD”)Community Development Block Grant-Disaster Recovery (“CDBG-DR”) funds administered by theNYS Governor’s Office of Storm Recovery (“GOSR”). Attention of bidders is particularly called toSection 3 requirements, M/WBE goals, Federal labor standards, Federal and State prevailing wage rates,online reporting requirements using Elation System, Inc. and other requirements included in the GOSRSupplementary Conditions for Contracts. Vendors awarded under this contract must use the Elationsystem to report compliance (www.elationsys.com).
MINORITY AND WOMEN OWNED BUSINESS PARTICIPATION GOALS
The following goals for MWBE participation on this project have been established at:
Minority Owned Business Enterprise (MBE) 7%
Women Owned Business Enterprise (WBE) 18%
SERVICE DISABLED VETERAN OWNED BUSINESS GOALS
The following goals for SDVOB participation on this project have been established at:
Service Disabled Veteran Owned Business (SDVOB) 4%
PROJECT COMPLETION
The completion date for this project is 365 days after agreement has been approved by the NYSComptroller’s Office.
PROJECT SPECIFIC LIQUIDATED DAMAGES (Refer to Table 14)
In the event the Contractor fails to complete all the work on time, the Contractor agrees to pay theOffice liquidated damages in the amount of $2,000.00 per day (as referenced in Article 14.10 of theGeneral Conditions).

Starting on the advertisement date, the Bidding and Contract Documents may be examined free ofcharge in person following registration at the Engineering Department at Administration Headquarters(9:00 a.m. 4:00 p.m.) at 625 Belmont Avenue, West Babylon, NY 11704. Bidding and ContractDocuments may be obtained free of charge by requesting registration from Margaret Ziminski atLIEngineering@parks.ny.gov. Following registration, a weblink will be provided to the registeredbidder where they can then access and download the Bidding and Contract Documents package thatincludes Drawings, Project Manual and Technical Appendixes.
Note: All potential bidders must register with the Agency so as to receive addendum items. Biddersthat do not register and cannot verify receipt of addendum items on the bid form may have theirbids disqualified.

BONDS
The successful bidder will be required to furnish a Performance Bond and a Labor and Material Bond inthe statutory form of public bonds required by Sections 136 and 137 of the State Finance Law, each for100% of the amount of the Contract.
PRE-BID MEETING and RFI
A pre-bid site visit meeting will be held on at 9:00 AM on May 13, 2021 at the Hempstead LakeState Park, Carousel Building. All prospective bidders are urged to attend.
All RFI’s are due by 20 May 2021 at 1:00 PM. Any RFI’s that are received after this time will NOT be processed.
PUBLIC BUILDING LAW 8(6)
Effective January 11, 2020, for any projects where the project design commenced on or after January 1,2020 and for any contracts over $5,000 for the work of construction, reconstruction, alteration, repair, orimprovement of any State building, a responsible and reliable NYS-certified Minority or Women-Owned Business Enterprise that submits a bid within ten percent of the lowest bid will be deemed theapparent low bidder provided that the bid is $1,400,000 or less, as adjusted annually for inflationbeginning January 1, 2020. If more than one responsible and reliable MWBE firm meets therequirements, the MWBE firm with lowest bid will be deemed the apparent low bidder.
