MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain Mortgage given by William McGuire to Mortgage Electronic Registration Systems, Inc., as nominee for New Century Mortgage Corporation, its successors and assigns, dated August 25, 2006 and recorded with the Essex County (Southern District) Registry of Deeds at Book 26043, Page 128, subsequently assigned to Deutsche Bank National Trust Company, As Trustee for Securitized Asset Backed Receivables LLC Trust 2007-NC2, Mortgage-Pass Through Certificates, Series 2007-NC2 by Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for New Century Mortgage Corporation, its successors and assigns by assignment recorded in said Essex County (Southern District) Registry of Deeds at Book 38240, Page 185 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on March 2, 2023 at 22 Country Hollow Lane, Unit 63, Building 15, Haverhill, MA, all and singular the premises described in said Mortgage, to wit: Unit No. 63 in Building 15, of the Country Hollow Village Condominium, Phase II-C, located at Country Hollow Lane, Haverhill, Essex County, Massachusetts, created by Master Deed dated October 8, 1987 and recorded with Essex South District Deeds in Book 9234, Page 386, as amended by First Amendment to Master Deed establishing Phase II-A dated October 16, 1987 and recorded in Book 9234, Page 476, as confirmed by instrument dated January 20, 1988 and recorded in Book 9368, Page 196, as further amended by Second Amendment to Master Deed establishing Phase II-B dated April 14, 1988 and recorded in Book 9478, Page 214, as further amended by Third Amendment to Master Deed establishing Phase II-C dated May 25, 1988 and recorded in Book 9534, Page 051, as further amended by Fourth Amendment to Master Deed establishing Phase III-A dated May 4, 1989 and recorded with said Registry. The Unit is laid out as shown on a plan filed with the Unit Deed, which is a copy of a portion of the plans filed with said Master Deed. and to which is affixed a verified statement in the form provided in Chapter 183A, Section 9 of the Massachusetts General Laws. Said Unit contains 2,113.89 square feet, more or less as set forth in said Master Deed. Said Unit is conveyed together with 1) the undivided percentage interest appertaining to the Unit in the common areas and facilities of the Condominium as described in the Master Deed and in the Country Hollow Village Condominium Trust recorded in Book 92343, Page 414; 2) an easement for the exclusive use of any crawl space, attic space, and cave space to which there is direct physical access from the Unit through existing openings; 3) an exclusive right and easement to use that parking space/garage which are identified as Parking Space Number 63 (and garage space 63) on the plan entitled “As Built Site Plan Country Hollow Village in Haverhill, Mass., Prepared for Country Hollow Realty Trust.” As revised and recorded; and 4) an easement for the exclusive use of any deck, porch, steps or platform attached to the Unit to which there is a direct access from the Unit through an existing doorway or opening. The Unit shall be occupied and used only for private residential purposes except as provided otherwise in the Master Deed and is conveyed subject to and with the benefit of easements, obligations, rights and restrictions of record and the terms and provisions of said Unit Deed and of said Master Deed, Trust, and Chapter 183A all as the same may have been, and may in the future from time to time be amended. For title reference see Deed recorded in Book 16786 at Page 385 as Document No. 507 on 01/03/01. Meaning and intending to convey and hereby conveying the same premises conveyed to me/us by deed dated 01/02/2001 and recorded with Essex South Registry of Deeds in Book 16786, Page 385. The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs. TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE. Other terms, if any, to be announced at the sale.
